IMPORTANT BIDDER APPROVAL REQUIREMENT
All prospective bidders must be approved by the Seller prior to participating in the auction. Bidder approval must be completed no later than 5:00 p.m. on the day prior to the auction.
It is the Seller’s intent to offer this farmland primarily to local and area agricultural producers, family farming operations, local landowners, and other approved private purchasers. Prospective bidders must complete the Auction Company’s registration and approval process prior to the deadline.

Tracts 1 & 2 Overview
Tracts 1 and 2 comprise an existing farm located in New Salem Township, McDonough County, Illinois, currently reported by the McDonough County Assessor as containing 162.83 acres. The farm will be divided into two approximately equal tracts, with Tract 1 comprising the western portion and Tract 2 comprising the eastern portion. Both tracts will be sold based upon final surveyed acreage.
This is highly productive Class A farm, with an average Productivity Index (PI) of approximately 141.5 across the existing farm. USDA Farm Service Agency records report 164.17 farmland acres, 163.95 cropland acres, and 163.04 NHEL (Non-Highly Erodible Land) acres.
Recent farm production information indicates average yields of approximately 225 bushels per acre for corn and 75 bushels per acre for soybeans.

TERMS OF SALE
The property is selling as-is, where-is, with all faults and is selling subject to easements, leases, restrictions, covenants, conditions, zoning, and all other matters which would be revealed by a current survey or inspection of the property or which are contained in the public records.
Seller reserves the right to cancel the sale and reserves the right to reject any and all bids. The property will be conveyed by Trustee’s Deed.

The property will sell as-is, where-is, with no warranty, expressed or implied, as to improvements, soil conditions, environmental conditions, wetlands, zoning, or other conditions affecting the property. No personal property will be conveyed with the real estate unless specifically identified in writing as being included in the sale.

BIDDER REGISTRATION & APPROVAL

CONTINGENCIES
This sale is not contingent upon the Purchaser's ability to obtain financing or an appraisal and is not subject to any inspection contingency. Prospective purchasers should complete any investigation or due diligence they deem necessary prior to bidding.
POSSESSION & CLOSING
Possession: The property is being sold subject to the existing farm lease for the 2026 farming season, which shall terminate no later than February 28, 2027.
Purchaser shall receive possession of the tillable acreage at closing, provided the 2026 crops have been harvested and removed. Purchaser shall thereafter have the right to access and prepare the tillable acreage for the 2027 farming season.
The existing farm tenant may continue to use the grain bins, barns, and other farm improvements following closing solely for the purpose of removing grain, equipment, personal property, and other items belonging to the tenant. All such property shall be removed and possession of the grain bins, barns, and other farm improvements surrendered to Purchaser no later than February 28, 2027.
Closing shall be held on January 19, 2027, at the offices of Barnhart, Tinsman & Parrish, Ltd., Canton, Illinois.
SURVEY
The property will be offered in three tracts. All advertised acreages are approximate and subject to final survey. Each tract shall be conveyed based upon the acreage determined by the final survey.
OPPORTUNITY CLAUSE
The property is available to qualified and approved purchasers without regard to race, color, religion, sex, marital status, national origin, disability, familial status, or any other characteristic protected by applicable federal or Illinois law.
Participation in the auction is subject to the Seller's bidder eligibility requirements and the Auction Company's registration and Seller’s approval process, which shall be administered in a nondiscriminatory manner consistent with applicable law.
DEBT COLLECTION & INTEREST CHARGE
The bidder agrees to pay all reasonable attorney fees and other costs incurred by Kelso Rhoades Real Estate Auction Group in its efforts to collect unpaid funds from the bidder. Any debt collection or dispute proceedings will be heard in McDonough County, Illinois.
BUYER'S PREMIUM
There is no buyer's premium for this auction.
GUARANTEE AGREEMENT
By submitting a bid in the name of a business entity, corporation, limited liability company, partnership, trust, or other entity, the individual submitting the bid personally guarantees payment of any bid amount not paid when due by the entity, for any reason, together with all collection expenses incurred to enforce collection, including reasonable attorney fees.
PROPERTY TAX PRORATION / FARM INCOME
Seller shall retain all farm income attributable to the 2026 farming season.
Seller shall be responsible for the entirety of the 2026 real estate taxes, due and payable in 2027. Purchaser shall receive a credit at closing for the 2026 real estate taxes based upon the most recent available tax information.
Purchaser shall be responsible for the entirety of the 2027 real estate taxes, due and payable in 2028, and all subsequent real estate taxes.
CLOSING EXPENSES
The Seller will be responsible for the title search and, at closing, will issue a commitment for an owner's policy of title insurance to the Purchaser in the amount of the purchase price. The Seller will also pay for preparation and transfer of the deed, applicable transfer taxes, and one-half of the actual closing fee.
TERMS FOR BIDDING
All bidders must complete the required registration and approval process no later than 5:00 p.m. on the day prior to the auction.
The successful bidder(s) will be required to execute a real estate sales contract immediately following the auction.
At the time of executing the sales contract, earnest money in the amount of 10% of the purchase price will be collected in the form of check, wire transfer, or certified funds. The balance of the purchase price shall be paid in full at closing on January 19, 2027.
The sale is not contingent upon financing, appraisal, or inspections. The terms of the executed real estate sales contract shall take precedence over any claims or statements made in this notice.
